Last week, the jury in the Jodi Arias murder trial found her guilty. Now the trial has moved on to the sentencing phase, being referred to as the ‘aggravation phase’. So named because if the court determines the murder was performed in a cruel manner, Arias could be sentenced to death. According to HLN, Arias spent this past weekend on suicide watch in the psych ward and was transferred back to the jail on Monday. Court was dismissed on Thursday last week abruptly when the sentencing phase was expected to begin.
At this point, the court is trying to determine whether Travis Alexander’s death meets the definition of a cruel manner. This would mean that the prosecution has to show that Alexander suffered physical pain or mental anguish and that Arias was aware of this, or should have been.
In the proceedings, the prosecution will have the opportunity to present new evidence in an attempt to prove that the case meets this definition. The jury will hear the new evidence and will then decide whether this aggravating factor of ‘cruelty’ has been proven.
